Big questions for SDSU as league dissolves
Should Boise and SDSU still pay an exit penalty when every team is leaving the Mountain West?

Them leaving is a big part of the reason the MW has to dissolve. They should absolutely have to pay their exit fees.

If that will legally hold up though that they would have to pay. If there is no league then no one to pay a few to.

Unfortunately, it will probably take a silly legal battle.
Fortunately, there is a pretty clear case to be made for cause and effect, like JPCWBYS said. Despite there not being a league, the member schools still exist. The fee can be divided among those schools.

The two conferences were already talking merger way before the Big East gave the invite. BSU and SDSU both voted to approve the merger. As for paying the exit fee, only if BSU leaves in 2012. The fee has to be paid when they officially leave the conference, which is July 1, 2013. By then the MWC will not exist. Therefore no penalty. I say the same goes for SMU, Houston, Memphis, and UCF as well.

BSU was not allowed into the Mtn West for many years even though we tried repeatedly to get in, and now it is BSU’s fault it is falling apart? Really? I think that Utah, BYU, and TCU leaving was the problem, not BSU.

We would have been happy to stay in a MW with BYU, TCU, Utah, and Nevada. It would have been stronger than the Big East, and dare I say it the ACC too. The MW would have applied for and gotten the AQ for the 2012 and 2013 seasons. But The Hair went and screwed the poach with the whole MTN fiasco. I don’t even blame TCU, et al. for leaving. Who would want to play in a conference with no national TV coverage? Of course they left. Blame The Hair. and no one else.

And add Hawaii and Fresno State to that mix and we would have had a great conference.
I like the poach better. its more fitting.
If the MWC wasn’t so small minded. They should have poached Nevada, and BSU 5 years ago, and then tried to do a merger with the Pac 10, at least in some back and forth competitions. Maybe even have a"Best of the West" series.

While BSU definitely helped add legitimacy to a conference that had it’s heart ripped out of it with the departures of BYU, TCU and Utah, it definitely was on the downward spiral long before BSU joined. Had the conference grabbed BSU and maybe Nevada a couple of years back they would’ve been in a much better position (although TCU and Utah would still probably be gone). The media deal is what did in the Mountain West conference, and any team that has found any kind of option that improves on this has bolted at the first chance. Blame the crappy media deal/exposure for the death of the Mountain West, not the teams that are leaving.

If BSU leaves in 2012 then yes they definitely needs to. For BSU and SDSU in 2013 however things get more than a little dicey. If it was simply a conference merger then BSU and SDSU should pay the fees as technically the legal entity of the Mountain West is still intact. HOWEVER, if as is claimed that the Mountain West and Conference USA dissolve and form a new conference/membership then IMHO nothing is owed as the conference and legal entity that is the Mountain West would cease to exist. Here is another twist though, what I could see happening is for the new conference to go though on say July 7th 2013, thereby forcing the departing CUSA teams and departing MWC teams to still pay their exit fees. All the teams are currently scheduled to officially become members of the Big East on July 1, 2013, so if they did it on that date and the old conferences would still collect their fees as they wouldn’t officially dissolve until about a week later.
Can you imagine the poopstorm that would cause?
The legal battles would last forever. Trust me. I have zero experience when it comes to legal issues.
